Sweepstakes Rules: 'Super Tenant of the Month'

MERCANTIL PLUS SERVICES MANAGEMENT IBERIA S.L. (hereinafter PLUS SERVICES), with registered office at Paseo de La Castellana 95, Madrid, and CIF B-87127692, will carry out a monthly promotion called 'SUPER TENANT OF THE MONTH' under the following conditions:

• 1. Duration

  The promotion will be valid monthly from November 2018.

• 2. Purpose

  This is a discount promotion aimed at enhancing brand image and encouraging tenants subscribed to Plus Services' services to regularly fulfill their rental obligations.

• 3. Mechanics and Participation Requirements

  • All tenants, consisting of at least one natural person, who rent properties with a signed contract for Plus Services' Rental Management and Protection service and have an active subscription under Plus Services' General Conditions will automatically participate.
  • The rent must be paid no later than the 1st day of the month in which the draw is held.
  • The tenant must correctly specify the Plus Services contract reference number in the rent payment description (e.g., MAD2812345678).

• 4. Exclusions

  The following are expressly excluded from participating in the 'SUPER TENANT OF THE MONTH' draw:

  • Employees, both direct and indirect, of Plus Services and its subsidiaries.
  • Tenants subscribed to Plus Services' Management and Protection service who have paid their rent later than the 1st day of the month corresponding to the draw.
  • Any tenant with outstanding payments to Plus Services and/or who is in the process of eviction.
  • Tenants who do not correctly specify the payment description according to their Plus Services contract.
  • Tenants whose service has ended or who are in their last month without a prior renewal.

• 5. Prizes

  Participants can win a 50% discount on their net rental fee associated with Plus Services' service each month. A single discount is drawn per month.

• 6. Prize Conditions

  • A 50% discount on the rental fee of the winning tenant.
  • The discount will apply to the month immediately following the draw.
  • The maximum gross discount amount will not exceed three hundred Euros (€300.00).
  • A tenant who has won may participate in future draws as long as they meet the other requirements.

• 7. Draw

  • The draw will take place monthly on the 3rd or the next business day if the 3rd is a holiday, before a notary at the office of José María Suárez Sánchez-Ventura and Gerardo Delgado García, located at Calle Doctor Calero 21, Majadahonda, Madrid. One winner and one alternate will be selected.
  • The winner may decline the prize, in which case it will automatically pass to the alternate. If the alternate also declines, no winner will be declared for that month.
  • Winners who decline the prize will be removed from future sweepstakes databases.
  • Winners will be notified by phone and email (previously provided in their Plus Services contract). If neither the winner nor the alternate can be reached, the prize will be forfeited.
  • Once the winner has been contacted and has accepted the prize, their name will be published on Plus Services' social media, website, and other promotional channels.
  • To claim the prize, winners must provide photos with promotional material supplied by Plus Services, in the format and quantity specified. If the winner does not agree to this, the prize will pass to the alternate, and they will be removed from future sweepstakes databases.

• 8. Data Processing

  Plus Services processes participant data for the management of this sweepstake.

  The legal basis for processing is the fulfillment of the contractual relationship required to participate. Plus Services will maintain confidentiality regarding personal data and may disclose it to authorities if legally required.

  Participant images may be published as winners or finalists in Plus Services' media, including social networks and websites, with no territorial or time restrictions.

  Participants have the right to access, rectify, delete, oppose, limit processing, and request portability of their data by emailing legal@plusservices.es or sending a postal request to Plus Services Management Iberia S.L., Paseo de La Castellana 95, Pl.15, 28046 – Madrid – MADRID.

• 9. Taxation

  The prizes in this promotion are subject to Spanish tax laws, including the Personal Income Tax Act (Ley 35/2006), its implementing regulations, and other relevant legal provisions.

  Participants are informed that prizes awarded through games, contests, raffles, or promotional combinations linked to the sale of goods or services are subject to withholding or advance payment of personal income tax (IRPF) if the prize value exceeds €300.

  In compliance with tax regulations, Plus Services will apply the appropriate withholding or advance payment and issue the corresponding tax certificate to the winner, who must declare the prize value as part of their taxable income.

  The winning participant must confirm their personal details on the prize collection day and present their ID or residence card. They must also sign a prize receipt document and provide a photocopy of their ID. Otherwise, they will lose the right to claim the prize.

  Providing the necessary personal and tax data for prize delivery is mandatory. Failure to do so will result in the forfeiture of the prize.

• 10. Use of Winner's Image

  The sweepstake winner authorizes Plus Services to use their name and image in promotional material related to this sweepstake (including internet, social media, and websites) without any financial compensation. This data transfer has no territorial or time restrictions.

  No personal data of participants will be disclosed to third parties except for the purposes of this promotion.

• 11. Jurisdiction

  Participants expressly submit to the Courts and Tribunals of Madrid for any dispute, discrepancy, controversy, or claim arising from the execution, interpretation, or compliance with this promotion, waiving any other applicable jurisdiction.

• 12. Cancellation, Modification, or Suspension of the Sweepstakes

  Plus Services reserves the right to cancel, modify, or suspend the sweepstake if necessary.

• 13. Liability

  Plus Services is not responsible for any losses, damages, thefts, delays, or any other circumstances caused by third parties that may affect the promotion.

  Under no circumstances will Plus Services be responsible for services provided to the winner by any other entity collaborating with this promotion.

• 14. Acceptance of the Rules

  By participating in the sweepstake, participants expressly accept these terms and conditions.

  Grupo Plus Services reserves the right to modify the rules, always in favor of the competition.

• 15. Registration of Rules

  The rules of this promotion are registered and notarized at the office of Notary José Mª Suárez Sánchez-Ventura in Madrid. They are available for consultation on the Plus Services website (www.plusservices.es) during the promotional period.
